Lecturer of the Faculty of Law (FH) Universitas Tarumanagara (Untar) Prof. Dr. Gunardi Lie, S.H., M.H. was inaugurated as a Professor of Business Law on Wednesday (12/10) at Main Building Auditorium, Untar Campus 1.
Gunardi Lie delivered an inaugural speech titled “Bankruptcy: Economic and Legal Institution, and its Reasoning in the Judicial System (Business Law and its Development in Indonesia)”.
The inauguration was conducted in an open session led by Rector of Untar Prof. Dr. Ir. Agustinus Purna Irawan, M.T., M.M., I.P.U., A.E. and witnessed by the Chairman of Tarumanagara Foundation Prof. Dr. Ariawan Gunadi, S.H., M.H, Vice Rector Dr. Rasji, S.H., M.H., and Dean of FH Untar Prof. Dr. Amad Sudiro, S.H., M.H., M.M., M.Kn.
The procession that was accompanied by traditional gamelan music was also attended by the Director of Resources of the Directorate General Diktiristek Kemendikbudristek Dr. M. Sofwan Effendi, M.Ed., Head of Higher Education Service Institute Region III (LLDikti III) Prof. Dr. Toni Toharudin, S.Si., M.Sc., and Chairman of ABPPTSI Prof. Dr. Thomas Suyatno.
In his inaugural speech, it was stated that there was a variation in the decision of the Indonesian bankruptcy court following the level of the judicial institution.
The variation shows the legal reasoning of the trial judge, namely legal certainty at the commercial court level, legal justice at the cassation level, and legal expediency by the Supreme Court Judge at the judicial review level.
“This is the trend of commercial court decisions, based on the results of my research, obtaining 55 research samples with cluster, stratified random sampling in five major cities in Indonesia,” he said.
In his speech, Prof. Gunardi highlighted the current problems that have the potential to lead to bankruptcy. Currently in various parts of the world such as the United States, India, the United Kingdom, Indonesia is faced with the problem of disruption of trade due to the Covid-19 pandemic, the war between Russia and Ukraine, and lately also the problem of changing from offline to online trade.
This clash of offline and online trading systems impacts Micro, Small and Medium Enterprises (MSMEs). Many manufacturers and large traders have gone out of business, resulting in potential financial difficulties, failure to pay, and bankruptcy.
“Currently, the government is preparing changes to the Bankruptcy Law, considering that there have been changes and developments in the global and national economic trading system lately, as well as indicating that the economy and law have a close relationship like two sides of a coin that cannot be separated,” said Prof. Gunardi.
Rector of Untar stated that business law is one of the excellence in Untar and connected to the values held by Untar, namely Integrity, Professionalism, and Entrepreneurship (IPE). In the future, business law at Untar will continue to be developed to be the best in Indonesia, even at the international level.
Prof. Dr. Gunardi Lie, S.H, M.H., is the 8th professor of FH Untar. During his time as a lecturer at Untar, the man born in Cirebon on March 25, 1959, has served as dean of the Faculty of Law (2004-2012), Head of Master of Law Study Program (2006-2008), and Chairman of Tarumanagara Foundation (2012-2022).
In 2023, Untar has conducted two inaugural processions of Professor of Law. Previously, Prof. Dr. Ariawan Gunadi, S.H., M.H. was inaugurated as the Youngest Professor in Business Law. (VW/YS/AW)
